🛒 Store Terms & Conditions
These Terms of Service (“Agreement”) are a legal agreement between you (“User,” “you,” or “your”) and Bumprkar (“Bumprkar,” “we,” “us,” or “our”), a delivery platform based in Pittsburgh, Pennsylvania. By accessing or using the Bumprkar app and its related services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to any part of these terms, please do not use the Bumprkar app or its services.
📱 Description of Service
Bumprkar is a mobile application that connects users with local drivers and carriers to facilitate the delivery of goods. The platform allows users to place delivery requests from vendors, merchants, and restaurants, after which a driver or carrier picks up and delivers the order to the designated location.
Bumprkar does not own or operate any vehicles, and all drivers and carriers are independent contractors. We charge a service fee based on the cost of delivery, which is clearly communicated to users prior to order confirmation. The fee is charged to the user's payment method at the time of the request. Bumprkar is not responsible for any fees incurred from your bank or financial institution.
💵 Fees
Bumprkar reserves the right to modify its fees at any time to ensure fair driver compensation and continued support for store partners. The current fee structure includes:

A 3.5% credit card processing fee per order

A $1.00 flat fee per order
Any future fee changes will be communicated in advance via the app, email, or other official communication channels. Continued use of Bumprkar after a fee update constitutes your acceptance of the new rates.
👤 Eligibility and Account Registration
To register and use Bumprkar, you must be at least 18 years old and legally able to enter into a contract. You must provide accurate and complete information and keep your account details up to date. You are solely responsible for the confidentiality of your account credentials and any activity that occurs under your account.
📏 User Conduct
By using Bumprkar, you agree to use the app in compliance with all laws and not to:

Harass, abuse, or harm anyone

Impersonate others or misrepresent affiliations

Post or transmit content that is defamatory, obscene, offensive, or otherwise unlawful

Violate intellectual property rights of Bumprkar or others

Attempt unauthorized access to Bumprkar’s systems or disrupt services
📸 Content Ownership and License
While Bumprkar does not claim ownership over content you submit, by posting content, you grant Bumprkar a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, adapt, publish, and distribute the content across any media or platform for any purpose.
🖼️ Acknowledgment of Stock Images
Some product images used on our platform may be stock photos or general representations. While we strive for accuracy, these images may not always reflect the exact product being delivered. By using Bumprkar, you acknowledge and accept that some visuals may be illustrative only. This approach helps us keep platform costs low and pass those savings to our store partners.
🛠️ Order Dispute Resolution
If an issue arises with a customer order, you agree to contact the customer directly to resolve the dispute. Vendor and restaurant contact details are available in the platform to support direct resolution.
💳 Payment
Charges for services are collected through the Bumprkar app at the time of order confirmation using the payment method you provide. You are responsible for ensuring payment details are accurate and valid.
⚠️ Disclaimers and Limitations of Liability
Bumprkar makes no guarantees regarding the availability, reliability, accuracy, or security of the app or its services. To the fullest extent allowed by law, we disclaim all warranties—including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Bumprkar shall not be liable for any indirect, incidental, consequential, special, or punitive damages related to your use of the platform.
🛡️ Indemnification
You agree to defend, indemnify, and hold harmless Bumprkar, its affiliates, and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses, including legal fees, arising from your use of the app, your violation of this Agreement, or any rights of a third party.
❌ Termination
Bumprkar may suspend or terminate your account or access to the app at any time, for any reason, and without prior notice. Upon termination, you must immediately cease using the app and its services.
⚖️ Governing Law and Dispute Resolution
This Agreement and any disputes arising from your use of the platform shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. All disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and the arbitrator’s decision may be enforced in any court with jurisdiction.
📌 Miscellaneous
This Agreement represents the entire agreement between you and Bumprkar regarding your use of the app and supersedes all prior communications, whether written or oral.
