📄 User Terms of Service

These Terms of Service (“Agreement”) constitute a legal agreement between you (“User,” “you,” or “your”) and Bumprkar (“Bumprkar,” “we,” “us,” or “our”), a delivery platform based in Pittsburgh, Pennsylvania. By accessing or using the Bumprkar app and its related services, you agree to be bound by these Terms of Service as well as our Privacy Policy. If you do not agree to these terms, please do not use the Bumprkar app or its services.

 

📱 Description of Service

Bumprkar is a mobile platform that connects users with local drivers and carriers to facilitate the delivery of goods. Users can submit delivery requests from vendors, merchants, and restaurants. Once an order is placed, a driver or carrier picks up and delivers the goods to the requested location.

Bumprkar does not own or operate any delivery vehicles. All drivers and carriers are independent contractors. Bumprkar charges a service fee based on the cost of the delivery, which is communicated to the user before accepting the quote. Fees are collected through the app at the time of the order. Bumprkar is not responsible for any additional fees charged by your bank or financial institution.

 

👤 Eligibility and Account Registration

To use Bumprkar, you must be at least 18 years old and have the legal capacity to enter into a contract. By registering, you confirm that you meet these requirements.

You are required to provide and maintain accurate and complete account information, including your profile image, home address, and payment details. You are also responsible for maintaining the confidentiality of your login credentials and agree not to share your account access. All activities that occur under your account are your sole responsibility.

 

📏 User Conduct

By using the Bumprkar platform, you agree to comply with all applicable laws and regulations. You may not use the platform to:

• Harass, abuse, or harm others

• Impersonate another individual or misrepresent your affiliation

• Share or post any content that is defamatory, obscene, offensive, or illegal

• Violate the intellectual property or proprietary rights of Bumprkar or others

• Attempt unauthorized access to Bumprkar systems or interfere with app operations

 

📸 Content Ownership and License

While Bumprkar does not claim ownership of content you submit through the app, by doing so you grant Bumprkar a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, and distribute your content across any medium or platform for any purpose.

 

🖼️ Acknowledgment of Stock Images

Images displayed on the platform may include stock images or product representations. These images are intended for general illustration purposes and may not reflect the exact product being delivered. By using Bumprkar, you acknowledge that some visual content may be representative in nature. We utilize these visuals to help lower platform operating costs and improve user experience.

 

📦 Order Dispute Resolution

If you experience a problem with an order, you agree to contact Bumprkar directly to resolve the dispute. Contact information is provided within the app for your convenience.

 

💵 Fees and Payments

Bumprkar does not charge users any fees to access or use the platform. Any fees paid during checkout are distributed as follows:

• Driver Compensation – 100% of the delivery fee is paid to the driver who fulfills the order

• Taxes and Regulatory Fees – When applicable, a portion of the charge is allocated to cover tax or legal obligations

Bumprkar does not collect any part of these fees as profit. By using the platform, you agree to this fee and payment structure.

 

⚠️ Disclaimers and Limitations of Liability

Bumprkar makes no guarantees regarding the suitability, reliability, availability, security, or accuracy of the platform or its services. All services are provided “as is,” and to the maximum extent permitted by law, we disclaim all express or implied warranties, including those of merchantability or fitness for a particular purpose.

Bumprkar is not liable for any indirect, incidental, consequential, special, or punitive damages related to your use of the app or any resulting loss.

 

🛡️ Indemnification

You agree to defend, indemnify, and hold harmless Bumprkar, its affiliates, and their officers, directors, employees, and agents from any claims, damages, or liabilities arising from your use of the platform, violation of this Agreement, or violation of any law or third-party rights.

 

❌ Termination

Bumprkar reserves the right to terminate your access to the app and its services at any time, for any reason, without prior notice. Upon termination, you must immediately stop using the app.

 

⚖️ Governing Law and Dispute Resolution

This Agreement and any disputes related to it shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. The arbitrator’s decision may be enforced in any court with proper jurisdiction.

 

📌 Miscellaneous

This Agreement constitutes the entire agreement between you and Bumprkar regarding your use of the platform, superseding any prior communications or agreements.

If any provision is deemed invalid or unenforceable, the remaining provisions will continue in full force. The failure of Bumprkar to enforce any part of this Agreement does not waive our right to enforce it later.
